This website is owned and operated by Ningaloo Coastal images and all images listed on this website are owned by the photographer/s who took them, no images can be used without prior written authorization from Ningaloo Coastal Images.

Use of stock Image/s when granted usage rights in writing.

The licensed individual/s of selected Stock Images MAY -
a. Make prints, modify or derive works of the Stock Image/s b. Use the Stock Image/s or Derive Works for any advertising, promotional materials, broadcast media and products in any quantity, provided the finished products are not designed or intended for re-sale of the Stock Images or Derived Works,
c. Incorporate the Stock Image/s in any on-line distribution system (including Licensee's web page) at a resolution no greater than 600x400 pixels (72dpi)..

1. In regards to photos listed on website/content or supplied copy you MAY NOT -
a. Use or copy the Stock Images unless permitted by www.ningaloocoastalimages.com.au b. Use or permit the use of Stock Images or claim any ownership rights of any sort of the Stock Images.
c. Sell license, distribute or otherwise grant rights or make available for use by others any portion of the Stock Image in form or formats designed or intended for re-use or re-sale of the Stock Images.

2. Copyright - The listed Stock Images are owned by www.ningaloocoastalimages.com.au and protected by Australian and international Copyright Law/s . Licensee must treat the Stock Images just as Licensee would any other copyrighted material. You may not copy the Stock Images, except as set forth in the "Use of Stock Images" section by using this website you are bound by all term and conditions listed on this page.

3. Photographer Credit All images must be credited to the photographer who took them and a copy supplied to Ningaloo Coastal Images or the work or publication they are used in and a link to our website.

4. Transfer - Licensee may not rent, lease, sub-license or lend the Stock Images, or any copy to another person who is not also a Licensee. For any transfer of license please contact www.ningaloocoastalimages.com.au

IN NO EVENT SHALL Ningaloo Coastal Images BE LIABLE FOR ANY LOST PROFIT, INCIDENTAL, OR PUNITIVE DAMAGES LICENSEE'S SOLE REMEDY REGARDING DEFECTIVE PRODUCTS SHALL BE REPLACEMENT OF THE MEDIA AND PRODUCTS IN QUESTION WITH Ningaloo Coastal Images MOST SIMILAR CURRENT PHOTO IN NO EVENT SHALL Ningaloo Coastal Images BE LIABLE FOR ANY AMOUNTS IN EXCESS OF THE AMOUNTS PAID In initial LICENSE TO Ningaloo Coastal Images. Under some circumstances, Ningaloo coastal Images may authorize a refund of the purchase price. Such refunds would be less shipping, handling and media costs, and subject to removal of all copies of images from licensee's systems, networks, media and printed materials.

5. Termination - This License shall automatically terminate upon failure by Licensee to comply with its terms.
